Hawaii Democrats to recommend 3 for US Senate seat

HONOLULU (AP) ? Hawaii Democrats on Wednesday were meeting to pick three names to forward to Gov. Neil Abercrombie as he considers an appointee to replace the late U.S. Sen. Daniel Inouye.

One by one, 13 of 14 candidates briefly made their cases before the state party's central committee in a meeting at the party's headquarters in small mall east of downtown Honolulu. Those not present made their cases in video messages, including U.S. Rep. Colleen Hanabusa, a frontrunner for the job thanks to Inouye himself.

The committee then met in private to name three finalists, picking the first three candidates who receive majority support from the committee.

Under Hawaii law, Abercrombie gets to make the final selection from the narrowed crop. The state party gets to pick three candidates because Inouye was a Democrat.

Before he died last week, Inouye pushed to be replaced by Hanabusa. He told Abercrombie in a letter it was his last wish.

Lt. Gov. Brian Schatz and incoming U.S. Rep. Tulsi Gabbard have also put in for the job, along with several candidates who hold smaller state offices.

The appointee will serve until a general election in 2014, when an election will be held to fill the seat through 2016, the end of Inouye's original term.

Hanabusa, 61, said in a video message played at the meeting that she's honored to have Inouye's support but she also is qualified to assume the seat and hit the ground running.

"Not one of us has any favorable rights to that position," Hanabusa said.

A member of the central committee gave a "Jersey Shore"-style fist pump as Hanabusa was introduced.

Schatz, 40, said that if appointed, he would try to make being a U.S. senator his life's work. Both he and Gabbard, 31, stressed the need to build up seniority over decades.

Gabbard spent part of Christmas Day tweeting and sharing messages of support for her candidacy through her campaign website. Among others, Newark, N.J., mayor Cory Booker said on Twitter that Gabbard should get the appointment.

It's not clear how much weight Abercrombie will give Inouye's letter as he considers his pick. His office has also not given a timetable for the selection, though Senate Majority Leader Harry Reid urged he make the selection quickly so the pick can take part in important votes at the end of the year, including legislation on the so-called fiscal cliff crisis.

The meeting included some lighter moments as longshot candidates took turns pleading their cases.

Timothy Hogan, the first candidate to speak, said he was a party faithful who would not run again in 2014. He said he wanted to serve as a "caretaker" for the seat for the party.

A woman who had called into the meeting by phone responded: "What about the seniority of the seat, you idiot," which drew gasps, laughs and calls from the audience to ask those who called in to mute their lines.

Another candidate, Antonio Gimbernat, called in from Maui and described himself as 44 years old, heterosexual, single with no kids and someone who likes to surf and play the ukulele. He said he has been sober for 12 years.

"TMI, dude," responded an audience member in the room.

Apply These Internet Promotion Tips To Your Plan - Maynas Eric

While a few businesses will grow from small beginnings to enormous size, others will remain small scale. Most, however, will just up and disappear. Many online businesses have been known to fail. Take some online marketing advice from this article to ensure that you beat the odds.

Even if you hit a few bumps in the road when it comes to web marketing, you must persevere. When you feel discouraged, remind yourself that success may be just around the corner. Make sure that all your priorities are set before you are going to launch a website that sells your products. Sometimes this takes intensive work. No matter how arduous this journey may be, always keep in mind that your efforts will pay off.

TIP! Using a web page for public relations can be an effective way to market your business on the internet. Include content that online magazines or newspapers may want to publish.

Here?s a tip for your internet promotion efforts. Make sure your readers know you take privacy and security seriously! Place a privacy policy on the upper right spot of the page. By adding the privacy policy to your site, your customers will feel more comfortable engaging in financial transactions with you. They will be more likely to purchase what you?re selling if they know you are protecting their identity.

Make sure you don?t overspend on advertising. Manage your money and don?t pay too much for advertisements, especially when they won?t necessarily help your business. Ensure you know exactly what you are getting for your money when you invest it in your business. For this reason, advertising using banner ads can be a smart investment.

You have probably heard that you shouldn?t mix your business with your personal life. However, this can be an exception to the rule. Simply due to the fact that this is more of a well paying past time without any high-pressure or stress. You should include your spouse in this activity, too.

TIP! By placing surveys and polls throughout your website, you can solicit feedback from site users. This can give you great ideas for new content, and help you populate your site with information your readers really want.

Partner with other online businesses to create interesting combination deals that will attract customers and help you share your customer bases. You can directly increase your sales volume by linking multiple markets. A good example of this is an online booking agent, which has negotiated reduced prices for people who book hotels, airfare and car rentals in one transaction. The best businesses to enter into packaging partnerships are those with products that are complementary, but not similar enough to cause direct competition.

It?s critical for internal links to promote your keywords. Keywords are how search engines find your site, so it?s an important part of website building. Provide your consumers with links to other relevant site content in order to keep them on your site for a longer period of time. By offering them links to your internal content, you not only retain your readers, but you can improve your search engine visibility.

Place ads for your business on high-traffic sites. Making this investment will pay off in the form of valuable exposure for your company or brand. Look for a site that gets lots of traffic, and this can help you get your name out there.

TIP! The most successful marketers online show real enthusiasm for the products they sell and have positive outlooks about their business. Communicate your faith in the product you sell and demonstrate to your potential customer how much you love the business you own.

Interview other people within your industry who can offer legitimate information to your customers. Be sure that you have permission from them before you publish so you don?t face legal trouble. Make your interviews articles and put them on free article and E-zine directories. The end results include increases in sales, traffic and even respect and credibility.

Offer proof that any claims you make about a product you are selling are true. Be believable in your claims and try to demonstrate the benefits of what you are promoting with a video, so that customers can see for themselves. Selling products you really use yourself allows you to provide your own authoritative views on their usefulness.

Failure in other businesses can be a catalyst to your success, so look for those open doors. Apply the helpful tips from this article to help you become a successful Online marketing guru.

TIP! An important tip regarding Internet marketing is to try to adjust your content and delivery of content in a way so that your customers get the impression that they are completely in control. Nothing can turn people off faster than unwanted email.

AP: 'Odd Couple,' 'Quincy' star Jack Klugman dies

Nina Prommer / EPA file

Jack Klugman in Santa Monica, Calif., in June 2008.

By Anthony McCartney, The Associated Press

LOS ANGELES -- Jack Klugman, the prolific, craggy-faced character actor and regular guy who was loved by millions as the messy one in TV's "The Odd Couple" and the crime-fighting coroner in "Quincy, M.E.," died Monday, a son told the Associated Press. He was 90.

Klugman, who lost his voice to throat cancer in the 1980s and trained himself to speak again, died with his wife at his side.

"He had a great life and he enjoyed every moment of it and he would encourage others to do the same," son Adam Klugman said.

Adam Klugman said he was spending Christmas with his brother, David, and their families. Their father had been convalescing for some time but had apparently died suddenly and they were not sure of the exact cause.

"His sons loved him very much," David Klugman said. "We'll carry on in his spirit."

Never anyone's idea of a matinee idol, Klugman remained a popular star for decades simply by playing the type of man you could imagine running into at a bar or riding on a subway with?-- gruff, but down to earth, his tie stained and a little loose, a racing form under his arm, a cigar in hand during the days when smoking was permitted.

The Odd Couple TV series intro.

His was a city actor ideal for "The Odd Couple," which ran from 1970 to 1975 and was based on Neil Simon's play about mismatched roommates, divorced New Yorkers who end up living together. The show teamed Klugman?-- the sloppy sports writer Oscar Madison -- and Tony Randall?-- the fussy photographer Felix Unger -- in the roles played by Walter Matthau and Art Carney on Broadway and Matthau and Jack Lemmon in the 1968 film. Klugman had already had a taste of the show when he replaced Matthau on Broadway and he learned to roll with the quick-thinking Randall, with whom he had worked in 1955 on the CBS series "Appointment with Adventure."

"There's nobody better to improvise with than Tony," Klugman said. "A script might say, 'Oscar teaches Felix football.' There would be four blank pages. He would provoke me into reacting to what he did. Mine was the easy part."

Actors Jack Klugman, left, portraying Oscar Madison, and Tony Randall, portraying Felix Unger, in a scene from their 1970's television series "The Odd Couple."

They were battlers on screen, and the best of friends in real life. When Randall died in 2004 at age 84, Klugman told CNN: "A world without Tony Randall is a world that I cannot recognize."

In "Quincy, M.E.," which ran from 1976 to 1983, Klugman played an idealistic, tough-minded medical examiner who tussled with his boss by uncovering evidence of murder in cases where others saw natural causes.

"We had some wonderful writers," he said in a 1987 Associated Press interview. "Quincy was a muckraker, like Upton Sinclair, who wrote about injustices. He was my ideal as a youngster, my author, my hero.

"Everybody said, 'Quincy'll never be a hit.' I said, 'You guys are wrong. He's two heroes in one, a cop and a doctor.' A coroner has power. He can tell the police commissioner to investigate a murder. I saw the opportunity to do what I'd gotten into the theater to do?-- give a message.

"They were going to do cops and robbers with 'Quincy.' I said, 'You promised me I could do causes.' They said, 'Nobody wants to see that.' I said, 'Look at the success of "60 Minutes." They want to see it if you present it as entertainment.'"

For his 1987 role as 81-year-old Nat in the Broadway production of "I'm Not Rappaport," Klugman wore leg weights to learn to shuffle like an elderly man. He said he would wear them for an hour before each performance, "to remember to keep that shuffle."

"The guy is so vital emotionally, but physically he can't be," Klugman said.

"We treat old people so badly. There is nothing easy about 80."

The son of Russian Jewish immigrants, he was born in Philadelphia and began his acting career in college drama (Carnegie Institute of Technology). After serving in the Army during World War I, he went on to summer stock and off-Broadway, rooming with fellow actor Charles Bronson as both looked for paying jobs. He made his Broadway debut in 1952 in a revival of "Golden Boy." His film credits included Sidney Lumet's "12 Angry Men" and Blake Edwards' "Days of Wine and Roses" and an early television highlight was appearing with Humphrey Bogart and Henry Fonda in a production of "The Petrified Forest." His performance in the classic 1959 musical "Gypsy" brought him a Tony nomination for best featured (supporting) actor in a musical.

He also appeared in several episodes of "The Twilight Zone," including a memorable 1963 one in which he played a negligent father whose son is seriously wounded in Vietnam. His other TV shows included "The Defenders" and the soap opera "The Greatest Gift."

In a 1987 interview in the New York Daily News, he said, "once I did three hourlong shows in 2? weeks. Think we'd do that now? Huh! But then it was great. I did summer stock, played the classics. Me!"

Throat cancer took away his raspy voice for several years in the 1980s. When he was back on the stage for a 1993 revival of "Three Men on a Horse," The Associated Press review said, "His voice may be a little scratchy but his timing is as impeccable as ever."

"The only really stupid thing I ever did in my life was to start smoking," he said in 1996. Seeing people smoking in television and films, he added, "disgusts me, it makes me so angry?-- kids are watching."

In his later years, he guest-starred on TV series including "Third Watch" and "Crossing Jordan" and appeared in a 2010 theatrical film, "Camera Obscura."

Klugman's hobby was horse racing and he eventually took up raising them, too.

"I always loved to gamble," he said. "I never got close to a horse. Fate dealt me a terrible blow when it gave me a good horse the first time out. I thought how easy this is.

"Now I love being around them."

Klugman's wife, actress-comedian Brett Somers, played his ex-wife, Blanche, in the "Odd Couple" series. The couple, who married in 1953 and had two sons, Adam and David, had been estranged for years at the time of her death in 2007.

In February 2008, at age 85, Klugman married longtime girlfriend Peggy Crosby.

In 1997, Klugman was sued by an ex-girlfriend, Barbara Neugass, who claimed he had promised to support her for the rest of her life. But a jury rejected her claim.

-- Biographical material in this story was written by former AP staffer Polly Anderson.

Nurse flees to Zimbabwe after battering UK girlfriend - Nehanda Radio

SURREY (UK) ? A Zimbabwean born nurse is on the run after being caught on CCTV beating up his girlfriend. Malvern Kurehwa (38) is being sought by Surrey Police for a separate matter and it is believed he has fled to Zimbabwe.

Police make an arrest in the UK

Police make an arrest in the UK

Kurehwa, from Rosehill, had pleaded guilty to battery of his girlfriend at Sutton Magistrates Court on October 20, 2009 and was ordered to pay a fine of ?230. As a result of the sentence, Kurehwa was told by the Nursing and Midwifery Council (NMC) his fitness to practice as a mental health nurse was compromised.

He was due to face the NMC on December 14 to hear the panel determine his future, but he failed to show up. He informed the panel in October this year that he was raising funds for a flight in order to attend the hearing. A panel decided in his absence that he should be struck off the nursing register.

The panel concluded that ?there is a real, current need for public protection in this case?. At the hearing at the International Dispute Resolutions Centre on Fleet Street, Central London, the panel heard about the incident which gave rise to his conviction.

On October 18, 2009, Kurehwa had called police from a phonebox in Rosehill claiming he was being attacked by his girlfriend.

However, CCTV footage in fact showed him punching his girlfriend in the head at least four times whilst holding her around her neck before dragging her to the floor and pushing her across the road.

A report of the NMC hearing said: ?In considering Kurehwa?s fitness to practise, the panel reminded itself of its duty to protect patients and its wider duty to protect the public interest which includes the declaring and upholding of proper standards of conduct and behaviour.

?The panel considered that Kurehwa?s actions are fundamentally incompatible with remaining on the register.?

Meanwhile, a Zimbabwean woman has admitted having false documentation, which allowed her to work as a nurse with Scotland?s largest health board. Asylum seeker Doreen Mutasa (31), was refused leave to stay in the United Kingdom in 2004 but was granted a temporary stay in 2010 on condition that she did not work.

The UK Border Agency later discovered that the Zimbabwean national had been using a false UK residence permit. Mustasa worked with NHS Greater Glasgow and Clyde from 2008 until 2012.?Surrey Comet/BBC

Home for the Holidays, or Not: An Expat Christmas in New York - IHT ...

NEW YORK ? I am American and I live abroad right here in New York. I know it doesn?t seem to make sense but it is true. Well that?s because I am French-American to be precise. I?ve lived and worked in New York for almost twenty years and I call it home ? except at Christmas time.

I love the days leading to Christmas in New York with the gorgeous light displays, the creative store windows, the Christmas music blaring in and out of stores, the thoughtful gifts from colleagues wrapped in reindeer- or snowmen-printed paper and the jolly end of year potluck parties.

But come Dec. 24, while I look at the colorful Christmas card display from my fellow American friends neatly hanging on a string above my fireplace, the words JOY and MERRY written on all of them make me sad and homesick.

My family is in France and on Christmas Eve, they will be celebrating Christmas without me.

Before my two children were born, I would always go back to France for the holidays. But now fares for a family of four at Christmastime are so expensive that I must make the choice to save our trip for a longer visit to France in the summer. Every year, I check the fares almost daily like we check the weather forecast.

But also every year, I am thankful for the numerous French stores in New York, especially French pastry and chocolate boutiques, for giving me consolation with a delightful taste of France.

The ?b?che de No?l,? the cream filled Christmas log, is a must in my house at Christmas. And so is good company to share the b?che with.

Since I don?t have the opportunity of sharing it with my family ? I will compare pictures of our respective b?ches via Skype though ? I invite dear friends who find themselves in the same predicament as me, far from their families at Christmas. Some are from Belgium, others as far away as Australia.

This year, my husband, children and I will be celebrating Christmas in Brooklyn with very dear friends: a Canadian and three Italians. In a way, although we will be eating a delightful homemade Italian meal and a delicious French b?che, we will be celebrating Christmas with an American spirit of cultural diversity. That?s heartwarming.

Joyeux No?l!

Conn. town in mourning inundated with gifts, money

NEWTOWN, Conn. (AP) ? Newtown's children were showered with gifts Saturday ? tens of thousands of teddy bears, Barbie dolls, soccer balls and board games ? and those are only some of the tokens of support from around the world for the town in mourning.

Just a little over a week ago, 20 children and six school employees were gunned down at Sandy Hook Elementary School. Twenty-year-old Adam Lanza killed his mother, attacked the school, then killed himself. Police don't know what set off the massacre.

Days before Christmas, funerals were still being held Saturday, the last of those whose schedules were made public, according to the Connecticut Funeral Directors Association. A service was held in Utah for 6-year-old Emilie Parker. Others were held in Connecticut for Josephine Gay, 7, and Ana Marquez-Greene, 6.

All of Newtown's children were invited to Edmond Town Hall, where they could choose a toy. Bobbi Veach, who was fielding donations at the building, reflected on the outpouring of gifts from toy stores, organizations and individuals around the world.

"It's their way of grieving," Veach said. "They say, 'I feel so bad, I just want to do something to reach out.' That's why we accommodate everybody we can."

The United Way of Western Connecticut said the official fund for donations had $2.8 million in it on Saturday. Others sent envelopes stuffed with cash to pay for coffee at the general store, and a shipment of cupcakes arrived from a gourmet bakery in Beverly Hills, Calif.

The Postal Service reported a six-fold increase in mail in the town and set up a unique post office box to handle it. The parcels come decorated with rainbows and hearts drawn by schoolchildren.

Some letters arrived in packs of 26 identical envelopes ? one for each family of the children and staff killed or addressed to the "First Responders" or just "The People of Newtown." One card arrived from Georgia addressed to "The families of 6 amazing women and 20 beloved angels." Many contained checks.

"This is just the proof of the love that's in this country," Postmaster Cathy Zieff said.

Peter Leone said he was busy making deli sandwiches and working the register at his Newtown General Store when he got a phone call from Alaska. It was a woman who wanted to give him her credit card number.

"She said, 'I'm paying for the next $500 of food that goes out your door,'" Leone said. "About a half hour later another gentleman called, I think from the West Coast, and he did the same thing for $2,000."

At the town hall building, the basement resembled a toy store, with piles of stuffed penguins, dolls, games, and other fun gifts. All the toys were inspected and examined by bomb-sniffing dogs before being sorted and put on card tables. The children could choose whatever they wanted.

Jugglers entertained the children, a dunk tank was set up outside and the crowd of several hundred parents and children sang an enthusiastic rendition of "Happy Birthday" to one child. A man dressed as Santa Claus was in attendance, and high school students were offering arts and crafts such as face painting and caricatures.

Newtown resident Amy Mangold, director of the local Parks and Recreation department, attended with her 12-year-old daughter, Cory. She acknowledged that most people here could afford to buy their own gifts but said "this means people really care about what's happening here. They know we need comfort and want to heal."

She pointed to two people across the room. "Look at that hug, that embrace. This is bringing people together. Some people haven't been getting out since this happened. It's about people being together. I see people coming together and healing."

Many people have placed flowers, candles and stuffed animals at makeshift memorials that have popped up all over town. Others are stopping by the Edmond Town Hall to drop off food, toys or cash. About 60,000 teddy bears were donated, said Ann Benoure, a social services caseworker who was working at the town hall.

"There's so much stuff coming in," said Tom Mahoney, the building administrator who's in charge of handling gifts. "To be honest, it's a bit overwhelming; you just want to close the doors and turn the phone off."

Mahoney said the town of some 27,000 with a median household income of more than $111,000 plans to donate whatever is left over to shelters or other charities.

Sean Gillespie of Colchester, who attended Sandy Hook Elementary, and Lauren Minor, who works at U.S. Foodservice in Norwich, came from Calvary Chapel in Uncasville with a car filled with food donated by U.S. Foodservice. But they were sent elsewhere because the refrigerators in Newtown were overflowing with donations.

"We'll find someplace," Gillespie said. "It won't go to waste."

In addition to the town's official fund, other private funds have been set up. Former Sandy Hook student Ryan Kraft, who once baby-sat Lanza, set up a fund with other alumni that has collected almost $150,000. It is earmarked for the Sandy Hook PTA.

Rabbi Shaul Praver of Congregation Adath Israel is raising money for a memorial to the victims. He said one man wrote a check for $52,000 for the project.

Several colleges, including the University of Connecticut, have set up scholarship funds to pay for the educations of students at Sandy Hook and the relatives of the victims.

Town officials have not decided yet what to do with all the money. A board of Newtown community leaders is being established to determine how it is most needed and will be best utilized, said Isabel Almeida with the local United Way, which has waived all its administrative fees related to the fund.

She said some have wondered about building a new school for Sandy Hook students if the town decides to tear the school down, but that decision has not been made.

And while the town is grateful for all the support, Almeida said, it has no more room for those gifts. Instead, she encouraged people to donate to others in memory of the Sandy Hook victims.

"Send those teddy bears to a school in your community or an organization that serves low-income children, who are in need this holiday season, and do it in memory of our children," she said.

What's the difference between an invention patent and an innovation ...

Query by denniscla: What is the distinction among an invention patent and an innovation pattent ?
Is an innovation a alter over one thing that is been invented?

Very best answer:

Yes. An invention is the act or [see also used clothing stores ] procedure of inventing even though an innovation is the act of introducing something new out of an existing invention.

Innovation is far more or [see also used clothing stores ] less just realizing how to market a product as best as feasible.

Nonetheless, coming up with a truly novel and non-clear thought/invention is far much more difficult, specifically with the lack of resources to aid in carrying out so. That is why invention is given significantly far more credit then innovation.

Top tech flops of 2012 tainted a good year for gadgets

20 hrs.

A lot of good things happened in tech this year.?The iPhone 5 premiered with 4G and a feather-light design. Google released its Nexus 7 tablet to go head-to-head with the Amazon Kindle Fire, and equipped it with Jelly Bean.?Samsung delivered a powerful one-two punch with the Galaxy S III and Galaxy Note II. And we saw a fair number of Ultrabooks that gave the MacBook Air?a run for its money.

But where there?s good, there?s bad. And there were plenty of major tech?fails this year. These awards go to the eight biggest.

Wrong-Way Award: Apple Maps
With all the anticipation surrounding iOS 6, many didn?t think twice about giving up Google Maps for Apple?s new Maps app. But once users switched over, the complaints and outcries that the iOS app was far inferior to Google Maps mushroomed. The app was riddled with errors ? including wrong addresses and warped-looking landmarks in the Flyover view ? while it lacked integrated mass-transit directions.

Apple eventually apologized for the Maps gaffe, and even recommended alternatives. CEO?Tim Cook probably put it best, saying, "We screwed up."

More:?7 Things Apple Must Do in 2013

False Start Award: Windows 8
After Microsoft?released a preview of the highly anticipated Windows 8, users were dismayed to find that, although the new system's classic "desktop" was practically identical to the Windows 7 interface, it lacked a Start menu. Microsoft had substituted the menu with a shortcut to the Start screen, which meant users are forced to leave the desktop just to launch an app that takes them right back to the desktop.

Talk about frustrating. The good news is that a number of third parties have stepped up to the plate with alternatives, including Stardock's Start8 and Samsung's S Launcher utility.

Worst Sales Pitch: Dell?s ?Daily Deals?
During Laptop's annual Tech Support Showdown, we made three calls to Dell's?tech support line and got more than we bargained for. During the calls, Dell pushed premium warranties on us, saying we had won a daily drawing that would allow us to buy a $500 four-year extended warranty for just $317. Lucky us ? we were chosen to spend even more money on something we didn?t need! When we resisted, the representative rushed us through the call, barely attempting to answer our question, but routinely haranguing us to buy the warranty, because otherwise the next caller would get our "prize."

According to Dell, using "drawings" as a sales tactic is against company policy. However, aggressively pushing extended warranties and hardware purchases is not, as we experienced on two other calls where support reps seemed more interested in making a commission than solving our problems.

IP-(Uh)-O Award: Facebook
Although Facebook?s IPO initially set a record for technology companies by raising more than $16 billion, it quickly became the decade?s worst initial public offering. When the social networking giant went public in May, its initial offering price was set at $38, while the company was valued at $104 billion. However, a little more than two weeks later, Facebook shares had dropped dramatically to $26.90 per share.

As it turns out, Facebook?s inability to monetize mobile traffic has caused a lot of concern among investors.?Although the stock has rebounded from a recent slide, the share is still way off the debut price.

Biggest Rip-Off Award: Shared Data Plans
In June, Verizon unveiled its new Share Everything plans, which allow customers to pay a flat fee for each device, plus a single charge for shared monthly data, which ranges from 1GB to 10GB. The plan includes unlimited voice minutes and text messages and makes you pay for them, whether you need them or not. As a result, a 2GB data plan costs $100 on the new plan while 2GB with a limited number of minutes and texts cost $70 on the old plan.

AT&T followed suit with similar Mobile Share plans. However, neither of these shared-plan options lets you opt for limited voice minutes or data. Plus, you still need to pay an additional monthly fee as you add devices, whether it?s a tablet?($15 for AT&T, $10 on Verizon Wireless) or mobile hotspot ($50 for AT&T, $20 for Verizon Wireless). At least AT&T kept its individual plans for those who don?t want to go the shared route.

Broken Promises Award: BlackBerry?10
BlackBerry 10 has become somewhat of a punchline in the tech industry, with the release of Research? In?Motion?s new mobile?OS continually delayed at a time when the straggling smartphone-maker should be trying anything to keep up with its Android and iPhone?competitors. After a brief demonstration of BlackBerry 10 at BlackBerry World in May, RIM pushed back the operating system?s release until Q1 of 2013, and soon after slashed 5,000 jobs.

Although there are some features in BB10 that look promising, many BlackBerry loyalists have already jumped ship. We'll find out in January if RIM has a shot at a better 2013.

More:?BlackBerry 10 Video Preview

Bait-and-Switch Award: Microsoft Surface
When commercials for the Microsoft?Surface started airing, viewers were enthralled by the device's Touch Cover. It came in fun, eye-catching colors and magnetically snapped onto the device for an easy typing experience.

One would assume that if Microsoft was putting the Touch Cover into its Surface commercials, it would come with the Surface, right? Wrong. Turns out the Touch Cover is a separate purchase, and shoppers would have to invest an additional $119 for the accessory ($100 if you buy it with the black one).

More:?Top 10 Windows 8 Tablet-Laptop Hybrids

Bad Idea Award: Google Nexus Q
Nexus Q could have easily made our list of most overpriced gadgets of all-time ... if it had actually come out. First shown and given to attendees at Google I/O 2012, the Nexus Q is a set-top box in the shape of an orb that streams music and movies to your home theater from Google Play ??and Google Play only.

While a $49 Roku box, a $99 Apple TV or a $99 Google TV box offers a variety of content services, even apps, the $299 Nexus Q didn't even have Netflix. Once you got over its unique design, the Nexus Q's main feature was allowing multiple users to add to the same playlist, something that was sure to create plenty of arguments among family members with different tastes. To Google's credit, the company quickly realized it had a dud on its hands, stopped accepting new orders and gave free units to anyone who had preordered.

Climate model is first to study climate effects of Arctic hurricanes

Monday, December 17, 2012

Though it seems like an oxymoron, Arctic hurricanes happen, complete with a central "eye," extreme low barometric pressure and towering 30-foot waves that can sink small ships and coat metal platforms with thick ice, threatening oil and gas exploration. Now climate scientists at the University of Massachusetts Amherst and in England report the first conclusive evidence that Arctic hurricanes, also known as polar lows, play a significant role in driving ocean water circulation and climate.

Results point to potentially cooler conditions in Europe and North America in the 21st century than other models predict.

Geoscientist Alan Condron at UMass Amherst and Ian Renfrew at the University of East Anglia, U.K., write in the current issue of Nature Geoscience that every year thousands of these strong cyclones or polar lows occur over Arctic regions in the North Atlantic, but none are simulated by the latest climate prediction models, which makes it difficult to reliably forecast climate change in Europe and North America over the next couple of decades.

"Before polar lows were first seen by satellites, sailors frequently returned from the Arctic seas with stories of encounters with fierce storms that seemed to appear out of nowhere," says Condron, a physical oceanographer. "Because of their small size, these storms were often missing from their weather charts, but they are still capable of producing hurricane-force winds and waves over 11 meters high (36 feet)."

He and Renfrew say that despite the fact that literally thousands of polar lows occur over the Arctic region of the North Atlantic ocean every year, none are simulated by even the most sophisticated climate models. To understand the importance of these storms on climate, Condron and Renfrew therefore turned to a new, state-of-the-art climate model to simulate the high wind speeds associated with these "missing" storms.

"By using higher resolution modeling we can more accurately simulate the high wind speeds and influence of polar lows on the ocean," Condron says. "The lower-resolution models currently used to make climate predictions very much miss the level of detail required to accurately simulate these storms."

He and Renfrew find that by removing heat from the ocean, polar lows influence the sinking of the very dense cold water in the North Atlantic that drives the large-scale ocean circulation or "conveyer belt" that is known as the thermohaline circulation. It transports heat to Europe and North America.

"By simulating polar lows, we find that the area of the ocean that becomes denser and sinks each year increases and causes the amount of heat being transported towards Europe to intensify," Condron points out.

"The fact that climate models are not simulating these storms is a real problem," he adds, "because these models will wrongly predict how much heat is being moving northward towards the poles. This will make it very difficult to reliably predict how the climate of Europe and North America will change in the near future."

Condron also notes that other research groups have found that the number of polar lows might decrease in the next 20 to 50 years. "If this is true, we could expect to see an accompanying weakening of the thermohaline circulation that might be able to offset some of the warming predicted for Europe and North America in the near future."

Best Practices for Computer Forensics in the Field | Computers and ...

Introduction

Computer forensic examiners are responsible for technical acuity, knowledge of the law, and objectivity in the course of investigations. Success is principled upon verifiable and repeatable reported results that represent direct evidence of suspected wrong-doing or potential exoneration. This article establishes a series of best practices for the computer forensics practitioner, representing the best evidence for defensible solutions in the field. Best practices themselves are intended to capture those processes that have repeatedly shown to be successful in their use. This is not a cookbook. Best practices are meant to be reviewed and applied based on the specific needs of the organization, the case and the case setting.

Job Knowledge

An examiner can only be so informed when they walk into a field setting. In many cases, the client or the client?s representative will provide some information about how many systems are in question, their specifications, and their current state. And just as often, they are critically wrong. This is especially true when it comes to hard drive sizes, cracking laptop computers, password hacking and device interfaces. A seizure that brings the equipment back to the lab should always be the first line of defense, providing maximum flexibility. If you must perform onsite, create a comprehensive working list of information to be collected before you hit the field. The list should be comprised of small steps with a checkbox for each step. The examiner should be completely informed of their next step and not have to ?think on their feet.?

Overestimate

Overestimate effort by at least a factor of two the amount of time you will require to complete the job. This includes accessing the device, initiating the forensic acquisition with the proper write-blocking strategy, filling out the appropriate paperwork and chain of custody documentation, copying the acquired files to another device and restoring the hardware to its initial state. Keep in mind that you may require shop manuals to direct you in taking apart small devices to access the drive, creating more difficulty in accomplishing the acquisition and hardware restoration. Live by Murphy?s Law. Something will always challenge you and take more time than anticipated ? even if you have done it many times.

Inventory EquipmentMost examiners have enough of a variety of equipment that they can perform forensically sound acquisitions in several ways. Decide ahead of time how you would like to ideally carry out your site acquisition. All of us will see equipment go bad or some other incompatibility become a show-stopper at the most critical time. Consider carrying two write blockers and an extra mass storage drive, wiped and ready. Between jobs, make sure to verify your equipment with a hashing exercise. Double-Check and inventory all of your kit using a checklist before taking off.

Flexible Acquisition

Instead of trying to make ?best guesses? about the exact size of the client hard drive, use mass storage devices and if space is an issue, an acquisition format that will compress your data. After collecting the data, copy the data to another location. Many examiners limit themselves to traditional acquisitions where the machine is cracked, the drive removed, placed behind a write-blocker and acquired. There are also other methods for acquisition made available by the Linux operating system. Linux, booted from a CD drive, allows the examiner to make a raw copy without compromising the hard drive. Be familiar enough with the process to understand how to collect hash values and other logs. Live Acquisition is also discussed in this document. Leave the imaged drive with the attorney or the client and take the copy back to your lab for analysis.

Pull the Plug

Heated discussion occurs about what one should do when they encounter a running machine. Two clear choices exist; pulling the plug or performing a clean shutdown (assuming you can log in). Most examiners pull the plug, and this is the best way to avoid allowing any sort of malevolent process from running that may delete and wipe data or some other similar pitfall. It also allows the examiner access to create a snapshot of the swap files and other system information as it was last running. It should be noted that pulling the plug can also damage some of

the files running on the system, making them unavailable to examination or user access. Businesses sometimes prefer a clean shutdown and should be given the choice after being explained the impact. It is critical to document how the machine was brought down because it will be absolutely essential knowledge for analysis.

Live Acquisitions

Another option is to perform a live acquisition. Some define ?live? as a running machine as it is found, or for this purpose, the machine itself will be running during the acquisition through some means. One method is to boot into a customized Linux environment that includes enough support to grab an image of the hard drive (often among other forensic capabilities), but the kernel is modified to never touch the host computer. Special versions also exist that allow the examiner to leverage the Window?s autorun feature to perform Incident Response. These require an advanced knowledge of both Linux and experience with computer forensics. This kind of acquisition is ideal when for time or complexity reasons, disassembling the machine is not a reasonable option.

The Fundamentals

An amazingly brazen oversight that examiner?s often make is neglecting to boot the device once the hard disk is out of it. Checking the BIOS is absolutely critical to the ability to perform a fully-validated analysis. The time and date reported in the BIOS must be reported, especially when time zones are an issue. A rich variety of other information is available depending on what manufacturer wrote the BIOS software. Remember that drive manufacturers may also hide certain areas of the disk (Hardware Protected Areas) and your acquisition tool must be able to make a full bitstream copy that takes that into account. Another key for the examiner to understand is how the hashing mechanism works: Some hash algorithms may be preferable to others not necessarily for their technological soundness, but for how they may be perceived in a courtroom situation.

Store Securely

Acquired images should be stored in a protected, non-static environment. Examiners should have access to a locked safe in a locked office. Drives should be stored in antistatic bags and protected by the use of non-static packing materials or the original shipping material. Each drive should be tagged with the client name, attorney?s office and evidence number. Some examiners copy drive labels on the copy machine, if they have access to one during the acquisition and this should be stored with the case paperwork. At the end of the day, each drive should link up with a chain of custody document, a job, and an evidence number.

Establish a Policy

Many clients and attorneys will push for an immediate acquisition of the computer and then sit on the evidence for months. Make clear with the attorney how long you are willing to maintain the evidence at your lab and charge a storage fee for critical or largescale jobs. You may be storing critical evidence to a crime or civil action and while from a marketing perspective it may seem like a good idea to keep a copy of the drive, it may be better from the perspective of the case to return all copies to the attorney or client with the appropriate chain of custody documentation.

Conclusion

Computer examiners have many choices about how they will carry out an onsite acquisition. At the same time, the onsite acquisition is the most volatile environment for the examiner. Tools may fail, time constraints can be severe, observers may add pressure, and suspects may be present. Examiners need to take seriously the maintenance of their tools and development of ongoing knowledge to learn the best techniques for every situation. Utilizing the best practices herein, the examiner should be prepared for almost any situation they may face and have the ability to set reasonable goals and expectations for the effort in question.

High court fight looms over right to carry a gun

WASHINGTON (AP) ? The next big issue in the national debate over guns ? whether people have a right to be armed in public ? is moving closer to Supreme Court review.

A provocative ruling by a panel of federal appeals court judges in Chicago struck down the only statewide ban on carrying concealed weapons, in Illinois. The ruling is somewhat at odds with those of other federal courts that have largely upheld state and local gun laws, including restrictions on concealed weapons, since the Supreme Court's landmark ruling declaring that people have a right to have a gun for self-defense.

In 2008 the court voted 5-4 in District of Columbia v. Heller to strike down Washington's ban on handgun ownership and focused mainly on the right to defend one's own home. The court left for another day how broadly the Second Amendment may protect gun rights in other settings.

Legal scholars say the competing appellate rulings mean that day is drawing near for a new high court case on gun rights.

The appeals court ruling in Chicago came early in a week that ended with the mass shooting in Connecticut that left 28 people dead, including 20 elementary school children and the presumed gunman.

Laurie Levenson, a professor at the Loyola Law School in Los Angeles, said that along with thorny legal issues, "we have the overlay of these tragedies hitting us on a somewhat regular basis."

The author of a book that traces the battle over gun control in the U.S. said he thinks Supreme Court intervention is likely in the short term. "Since the Heller case, the next great question for the Supreme Court to decide was whether there is a right to carry guns in public," said UCLA law professor Adam Winkler, whose book "Gunfight" was published last year.

Wambach scores twice, US women beat China 4-1

By SANTOS PEREZ

Associated Press Sports

updated 8:25 p.m. ET Dec. 15, 2012

BOCA RATON, Fla. (AP) - Abby Wambach scored twice to help the United States close out the season with a 4-1 exhibition victory over China on Saturday night.

The 32-year-old Wambach has 152 international goals, six behind Mia Hamm for the U.S record.

Megan Rapinoe and Sydney Leroux also scored for the Olympic champion Americans in their third consecutive match against China in the finale of a 10-game Fan Tribute Tour. The U.S. ran its unbeaten streak to 23.

The United States opened the scoring on Wambach's goal in the 18th minute. Alex Morgan's pass from the left wing found Wambach near the 6-yard box, and Wambach headed Morgan's cross inside the left post.

Rapinoe scored in the 36th minute with a 40-yard blast.

China cut the deficit to 2-1 in the 45th minute on Han Peng's goal.

Wambach scored her second goal in the 64th minute, and Leroux capped the scoring in the 87th.

Backbencher: Cameron 'will regret' backing gay church weddings

Tory backbencher Stewart Jackson said David Cameron risked undermining his own leadership by supporting gay church weddings:

I think it opens a can of worms that will lead to a great deal of social division.

I think it is something he will regret. There is no mandate for this. It was not in our election manifesto. It is being foisted on the Conservative Party.

David Cameron has got to think of his leadership and this will do him no good.
