Direct Tax Code vis-?-vis Income Tax Act,1961

Direct tax is the tax which is charged directly on the tax payer. ?In other words direct tax is that tax that is deducted from one?s salary.

In the general sense, a direct tax is one paid directly to the government by the persons on whom it is imposed which is? accompanied by a tax return filed by the taxpayer). Examples include some income taxes, some corporate taxes, and transfer taxes such as estate (inheritance) tax and gift tax. Some commentators have argued that ?a direct tax is one that cannot be shifted by the taxpayer to someone else, whereas an indirect tax can be.
Direct Taxation in India:

Direct taxation in India is governed by Income Tax Act, 1961 and? taken care by the Central Board of Direct Taxes (?CBDT?); it is a division of Department of revenue under Ministry of Finance. CBDT is governed by the Revenue Act, 1963. CBDT is given the authority to create and control direct taxes in India. The most important function of CBDT is to manage direct tax law followed by Income Tax department.
Under Income tax Act, 1961(?Act, 1961?), taxes are charged on the basis of residential status and not on the basis of citizenship. The assesses are charged based upon the following factors

Resident
Resident but not ordinary resident.
Non-resident.

Capital gains tax, personal income tax, tax on corporate income and tax incentives all come under the purview of direct tax.

An?income tax?is a?tax?levied on the?income?of individuals or businesses (corporations or other legal entities. When the tax is levied on the income of companies, it is often called a?corporate tax, corporate income tax, or profit tax.

Direct Tax Code:

TheDirect Tax Code (?DTC?) is said to replace the existing?Act in?India. It is expected to be enforced from?2012. During the budget 2010 presentation, the?finance?minister Mr. Pranab Mukherjee reiterated his commitment to bringing into fore the new DTC into force from 1^st?of April, 2011, but same could not be fulfilled and now it will be applicable from?1st April, 2012.[1]

The draft DTC along with a Discussion Paper was released in August, 2009 for public comments. Since then, a number of valuable inputs on the proposals outlined in these documents have been received from a large number of organizations and individuals. These inputs have been examined and the major issues on which various stakeholders have given their views have been identified. This Revised Discussion Paper addresses these major issues. There are a number of other issues which have been raised in the public feedback, which, though not part of this Discussion Paper, will be considered while finalising the Bill for introduction in Parliament.

?The key objective underlying the proposed enactment of the DTC is to mitigate the uncertainty and complexity created by the existing patchwork of direct tax legislations and annual finance acts,?. ?At the same time, the DTC has not lost sight of the need for flexibility and ensures that amendments ? of tax rates, for instance ? can be accommodated within the schedules to the DTC. While the DTC has proposed to lower corporate tax rates simultaneously it incorporates new provisions which will result in broadening the tax base,?.

One aim of the new tax code is to provide a system which takes into account the increase in cross-border mergers and acquisitions undertaken by Indian companies over the last few years. In addition, while lowering corporate tax rates, the DTC aims to remove the administrative burden on foreign companies and investors for whom the country is now a leading target for investment. By implementing the new code, the Government of India also intends to streamline and simplify legislation, as well as iron out many ambiguities in the current system[2].

The issues which this Revised Discussion Paper addresses are:

??? iii.??????????? Minimum Alternate Tax;

??? iv.??????????? General anti avoidance Rules;

????? v.??????????? Double Taxation Avoidance Agreement;

? vii.??????????? Royalties and Fees for Technical services;

Controlled Foreign Companies;

??? ix.??????????? Wealth Tax.

Comparative Analysis of provisions :

DTC discusses the test of residence of a person for tax purposes. The tax residence of companies (that is, where companies are established or carry on business) is usually based on either place of incorporation (legal seat), location of management (real seat) or a combination of the two. The DTC provides that a company incorporated in India will always be treated as resident in India. However, a company incorporated abroad (foreign company) can either be resident or non-resident in India. It has been proposed in the DTC that a foreign company will be treated as resident in India if, at any time in the financial year, the control and management of its affairs is situated ?wholly or partly? in India (it need not be wholly situated in India, as at present).

Generally, the test of residence for foreign companies is the ?place of effective management?or ?place of central control and management?. At the same time, it is noted that the existing definition of residence of a company in the Act based on the control and management of its affairs being situated wholly in India is too high a threshold.? Place of effective management? is an internationally recognized concept for determination of residence of a company incorporated in a foreign jurisdiction.[3]

A company is said to be Resident in India only if, the company is controlled and managed wholly partly in India at any time during the said financial year[4].

A company is said to be Resident in India if the place of effective management of company is in India. ?Place of effective management of company? means-

the place where the board of directors of the company or its executive directors, make their decisions; or
In a case where the board of directors perform their functions.?
Impact:

Such proposed change may create difficulties in implementation as their could be difference of opinion in regard to where is placed effective management

Taxation?of companies:

Under present legislation, the Domestic companies and Foreign companies are taxed at different rates, where there income exceeds 1 crore but DTC has proposed to make a uniformity in taxation of Domestic and Foreign companies at a same rate.

Under present law, Domestic companies are taxable @ 33.90% where income exceeds?`?1 crore and Foreign companies are taxable @ 42.33% where income exceeds?`?1 crore.

Under DTC, the proposal is to tax all companies including the foreign companies @ 30% and thus, to make a uniformity in taxation of companies.

Marginal relief for domestic companies.Welcome proposition for foreign companies- relief of about 13% on tax rates. However, profits of Indian branches of foreign companies will be subject to additional ?Branch Profits Tax? leviable @ 15%.

Minimum Alternate tax:

The DTC has proposed a Minimum Alternate Tax (?MAT?) on companies calculated with reference to the ?value of gross assets?. The economic rationale for the assets tax is that investors can expect ex-ante to earn a specified average rate of return on their assets, hence it provides an incentive for efficiency.Computation of MAT with reference to gross value of assets will require all companies to pay tax even if they are loss making companies or operating in a cyclical downturn[5]

Under present law, MAT rate is @ 19.93% (inclusive of surcharge and education cess) where income exceeds?`?1 crore. Tax credit for MAT paid is available for 10 years.

Under DTC, MAT is proposed to be taxed @ 20% without any surcharge and education cess.Credit for MAT is proposed for 15 years.[6]

After such proposed change MAT rate of tax increases slightly but Credit for MAT gets extended from 10 years to 15 years.

General Anti Avoidance Rules (?GAAR?):

DTC deals with the provisions of the General Anti Avoidance Rule (GAAR). The harmful effects of tax avoidance on the tax base, on tax equity and on the compliance regime have been discussed at length. The need for general anti avoidance provisions instead of legislative amendments to deal with specific instance of tax avoidance has also been discussed. The GAAR provisions apply where a taxpayer has entered into an arrangement, the main purpose of which is to obtain a tax benefit and such arrangement is entered or carried on in a manner not normally employed for bona-fide business purposes or are not at arm?s length or abuses the provisions of the DTC or lacks economic substance.

There is no provision with respect to GAAR in the present law.

The following safeguards are also proposed for invoking GAAR provisions:-

The Central Board of Direct Taxes will issue guidelines to provide for the circumstances under which GAAR may be invoked.
GAAR provisions will be invoked only in respect of an arrangement where tax avoidance is beyond a specified threshold limit.
The forum of Dispute Resolution Panel (?DRP?) would be available where GAAR provisions are invoked.
Impact

Such proposed change can lead to harassment and hardship for taxpayers.

5.????? DOUBLE TAXATION AVOIDANCE AGREEMENT (?DTAA?):

Under the current provisions of Act, 1961, the Domestic law and DTAA, the one which is more beneficial to taxpayer will apply But DTC provides that, DTAA will not have preferential status over the domestic law in the specified circumstances.

The current provisions of the Income-tax Act provide that between the domestic law and relevant DTAA, the one which is more beneficial to the taxpayer will apply. However, this is subject to specific exceptions e.g., the taxation of a foreign company at a rate higher than that of a domestic company is not considered as a less favourable charge in respect of the foreign company.

It is proposed to provide that between the domestic law and relevant DTAA, the one which is more beneficial to the taxpayer shall apply. However, DTAA will not have preferential status over the domestic law in the following circumstances:-

when the General Anti Avoidance Rule is invoked, or
when Controlled Foreign Corporation provisions are invoked or
when Branch Profits Tax is levied. [7]
Impact:

This limited treaty override is in accordance with the internationally accepted principles. Since anti-avoidance rules are part of the domestic legislation and they are not addressed in tax treaties, such limited treaty override will not be in conflict with the DTAAs. Further this will not deprive any taxpayer of any intended tax benefit available under the DTAAs.

Branch profit tax:

Under DTC additional levy of Branch Profit Tax (?BPT?) @ 15% is proposed. The same is to be levied on the total income for the financial year as reduced by the amount of income tax thereonForeign Companies liable to pay branch profit tax on total Income reduced by corporate tax.

There is no provision with respect to BPT in the present law.

Under DTC, it is proposed to levy Additional branch profit tax @ 15% on all foreign companies having any form of PE in India.

This can have dampening effect on foreign trade transactions and volumes.

Royalties and Fees for Technical services:

The ambit of fees for technical services (?FTS?) widened to include development & transfer of design, drawing , plan & software or similar services. The ambit of Royalty widened to include the consideration for use/right to use of transmission by satellite, cable, optic fibre, ship or aircraft and live coverage of any event

Currently, royalty and FTS are taxable @ 10% on gross income for foreign companies[8]

Under DTC, Royalty and FTS proposed to be taxed @ 20% on gross income for foreign companies

Rate of tax on these income is proposed to be doubled. Can adversely affect import of technology in the country.

Controlled foreign companies (?CFC?):

It is proposed to introduce Controlled Foreign Corporation provisions so as to provide that passive income earned by a foreign company which is controlled directly or indirectly by a resident in India, and where such income is not distributed to shareholders resulting in deferral of taxes, shall be deemed to have been distributed. Consequently, it would be taxable in India in the hands of resident shareholders as dividend received from the foreign company[9].

There are no rules concerning CFCs in the current legislation.

CFC provisions have been introduced to tax passive income earned by a foreign company (controlled directly or indirectly by a resident in India).

Under proposed CFC rules, even income of such foreign companies not distributed to shareholders would be deemed to be distributed and consequently taxable in India in the hands of resident shareholders as dividend received from the foreign company.

The proposal can affect outbound investments. There is no provision for getting credit for taxes paid abroad. This can result in double taxation.

Wealth tax:

DTC deals with the levy of wealth tax. Under the DTC, wealth-tax will be payable by an individual, HUF and private discretionary trusts. It will be levied on net wealth on the valuation date i.e. the last day of the financial year. Net wealth is defined as assets chargeable to wealth-tax as reduced by the debt owed in respect of such assets. Assets chargeable to wealth-tax shall mean all assets, including financial assets and deemed assets, as reduced by exempted assets. Exempted assets include stock in trade, a single residential house or a plot of land etc. The net wealth of an individual or HUF in excess of Rupees fifty crore shall be chargeable to wealth-tax at the rate of 0.25 per cent. Wealth tax Act, 1957 is applicable but there is no wealth tax is levied on companies.

Wealth tax is proposed on wealth exceeding?`?1 crore. Tax generally on non-productive assets. However value of equity in preference shares held by a resident in controlled foreign company will be liable to tax.

Companies hitherto non-taxable will be taxable. Favourable aspect is that limit of?`?30 lakh gets extended to?100 lakh.

CONCLUSION:

Thus, it can be said that the key objective underlying the proposed enactment of the DTC is to mitigate the uncertainty and complexity created by the existing patchwork of direct tax legislations and annual finance acts,?.

However, the professional community is divided over the logic and scope of some of the Code?s provisions and some experts are anxious about the impact such legislation will have on business and investment activity. The need to maintain a balance between reaping tax rewards under the new legislation and maintaining the interest of businesses and investors is of utmost importance. There is some anxiety as to whether the DTC achieves this balance, especially given the Government of India?s reputation for enforcing tax legislation. ?Since there is a direct correlation between taxation and economic growth, tax policies need to be directed so they achieve objectives such as increasing growth, savings and investments, consumption, and so on,?. ?Although the goals of the DTC are laudable, some of the provisions raise concerns stemming largely from an unsatisfactory experience with the manner of enforcement of tax provisions at the field level.?

Student in Twitter threat ordered to avoid Kent St

COLUMBUS, Ohio (AP) ? A Kent State University student accused of posting a message on Twitter saying he would be "shooting up" the northeastern Ohio campus was instructed Monday to stay away from the school and its president.

William Koberna, a 19-year-old sophomore, was set to be released Monday after posting part of a $50,000 bond set at Portage County Municipal Court in Ravenna, about 20 miles east of Akron. He appeared via video from the Portage County Jail.

Conditions of his bond require Koberna to wear a GPS tracking device and to stay away from university President Lester Lefton and the school.

University officials say an employee was monitoring social media mentions of the school when a profanity laced tweet posted July 25 was discovered. The public tweet mentioned Kent State University, identified the university president by name and included a threat that he planned to be "shooting up" the school. The tweet ended with "ASAP." It is no longer available.

Koberna was arrested Sunday afternoon at his parents' home in the Cleveland suburb of Brunswick after university officials contacted police about the tweet. Officials say he was taken into custody without incident.

"Our primary concern is keeping the school safe," said university spokesman Eric Mansfield. "We took this tweet very, very seriously, which is why we contacted police so quickly."

Koberna has been charged with inducing panic, a felony, and aggravated menacing, a misdemeanor. A preliminary hearing is scheduled Friday at the Kent branch of Portage County Municipal Court. Court records do not list an attorney for the teen. Public records also do not list a phone number for him.

Mansfield said university officials are meeting Monday to discuss what disciplinary actions will be taken against Koberna. He could face possible suspension or expulsion.

"Any threat to our campus community is taken seriously and immediately investigated," said Lefton in a statement on the university's website posted to students and staff. "Our students, employees, and all those who come to campus should know that their safety is our top priority."

Mansfield said officials do not ignore any threat to the school, especially after a recent shooting at a movie theater in Aurora, Colo., left 12 dead and 58 injured during a midnight showing of the new Batman movie.

"In light of what took place in Aurora, Colo., and with Columbine and Virginia Tech and even Chardon, we can't take any chances," he said.

Chardon is a city in northeast Ohio where three students were killed and three others were injured February. A teen has pleaded not guilty to charges in the shooting rampage at Chardon High School, east of Cleveland.

"We're not playing games," Mansfield said. "When someone posts something like this, we're going to respond immediately to make sure our campus is safe."

Koberna, a computer science major, is studying at the school's College of Arts and Sciences. He was living off campus and wasn't taking any summer classes.

Kent State was the scene of deadly gunfire in May 1970, when Ohio National Guardsmen opened fire during an anti-war protest. Four students were killed and nine others were wounded.

American swimmer Dana Vollmer won the 100 butterfly gold medal in world record time, while South Korea took gold in women's team archery for seventh straight time.

Cameron van der Burgh of South Africa captured Olympic gold in the 100 breaststroke in world record time and Kim Rhode won women's skeet gold to become the first American with an individual medal in five straight Olympics.

Phelps blow as China make history

America's Ryan Lochte left record-chasing Michael Phelps trailing Saturday in a storming start to the London Olympics -- while China's Sun Yang and Ye Shiwen wrote their name in the record books.

Lochte's 400m individual medley showdown with Phelps turned out to be a no-contest as he dominated to win in 4min 05.18sec, ahead of Brazilian Thiago Pereira and Japan's Kosuke Hagino, with Phelps back in fourth.

The loss is a setback for 16-time medallist Phelps, who memorably won a record eight titles in Beijing, and needs just three more medals to overhaul Soviet gymnast Larisa Latynina's all-time best of 18.

"It was just a crappy race," Phelps said. "I felt fine the first 200 and then I couldn't really go the last 100."

Phelps has another six events to go. But Lochte was not the only star of the first full day of action as Sun became China's first ever male Olympic champion in the pool, with a commanding swim in the 400m freestyle.

Sun's clash with champion Park Tae-Hwan was also much anticipated, but it almost didn't happen after the South Korean was disqualified from his heat for a false start, before being reinstated after an 11th-hour appeal.

Their race was a classic, with Sun gradually reeling in the leading Park before leaving him for dead over the closing stages with a time of 3:40.14. Park took silver with America's Peter Vanderkaay claiming bronze.

But the stand-out swim of the pool's opening night belonged to Ye, 16, who shattered the 400m medley world record with 4:28.43 -- more than a second faster than defending champion Stephanie Rice's time from Beijing 2008.

Ye swam a lightning closing freestyle leg as she overtook pace-setting Elizabeth Beisel and finished nearly two body-lengths in front. America's Beisel was second and China's Li Xuanxu third, with Rice joint sixth.

Australia won their first gold in the women's 4x100m relay, with Alicia Coutts, Cate Campbell, Brittany Elmslie and Melanie Schlanger beating out the Netherlands and teen star Missy Franklin's American team.

After Friday's lavish opening ceremony, it was a packed first day of full action with competition in 19 sports, from the far-flung rowing lake of Eton Dorney and across east London's Olympic Park.

Kazakh cyclist Alexandre Vinokourov shocked hosts Britain in the men's road race, and tennis stars Roger Federer and Serena Williams made progress in the familiar surroundings of Wimbledon.

Chinese world number one shooter Yi Siling had the honour of claiming the first of the Games' 302 golds at the Royal Artillery Barracks in the women's 10m Air Rifle.

Russia's Arsen Galstyan won the men's under-60kg judo and Sarah Menezes took Brazil's first Olympic gold in the sport, in the women's under-48kg.

But the story of the under-48kg was Hungary's Eva Csernoviczki, who bounced back from being strangled unconscious in the quarter-finals to claim an unlikely bronze.

In the men's cycling, Britain's Tour de France heroes Bradley Wiggins and Mark Cavendish were undone by a combination of tactical racing and some incisive, late attacks, finishing well off the podium.

"It just seems like the other teams are happy not to win as long as we don't win," grumbled British hope Cavendish.

South Korea enjoyed a golden start when sharpshooter Jin Jong-Oh won the Olympic men's 10m air pistol gold medal.

And New Zealand's Hamish Bond and Eric Murray set the third world record of the Games, in the men's pairs rowing.

South Korea had set new individual and team men's archery records on Friday thanks to the form of legally blind archer Im Dong-Hyun.

But they could not keep up their magnificent scoring and finished behind third in the team competition behind Italy and the United States.

Saturday also witnessed the first failed drugs test of the Games after Albanian weightlifter Hysen Pulaku was suspended for taking the banned steroid stanozolol -- the same drug that cost Canada's Ben Johnson his 100m athletics gold at the 1988 Seoul Games.

Federer, seeking singles gold to go with his 2008 doubles title -- and 17 grand slams -- survived a scare before beating Colombia's Alejandro Falla in three sets at Wimbledon, where he claimed his seventh title this month.

Williams, cheered on by US First Lady Michelle Obama, crushed Jelena Jankovic 6-3, 6-1.

UN arms treaty talks go down to the wire

Negotiations were coming down to the wire at the United Nations Friday to craft a landmark treaty to regulate the $70 billion global arms trade.

Expressing concern over the "very limited progress" made during month-long negotiations, Secretary-General Ban Ki-moon on Thursday urged member states to "show flexibility and work in good faith towards bridging their differences."

A draft treaty circulated Tuesday was severely criticized by rights groups, including Amnesty International and Oxfam, as full of "ambiguities and loopholes," especially in not including ammunition and allowing too much scope for arms transfers that would escape the treaty.

A second draft proposed Thursday evening by Argentine career diplomat Roberto Moritan, who has presided over the negotiations, is an improvement, according to Amnesty International's senior director for law and policy, Widney Brown.

"Some of the significant loopholes that we were concerned about have -- if not been closed -- definitely been narrowed," she explained to AFP.

According to the text, every country must determine if the arms sold may be used to perpetuate human rights violations or terrorism.

A British diplomat said the text represents "a substantial improvement," and that an accord is "now very close."

Diplomats said major concessions are necessary to obtain the signatures of major market players like Europe, the United States, Russia and China.

A small group of states, including Syria, Iran, North Korea and Cuba, have long worked to block a binding treaty and could formally reject the text.

If international players come to a consensus, Moritan will transmit the text to the UN General Assembly.

Individual countries then will decide whether to ratify the treaty, which needs 65 signatures to enter into force.

111 killed in Iraq's deadliest day in two years

A wave of violence killed 111 people across Iraq on Monday, the country's deadliest day in two and a half years, after Al-Qaeda warned it would seek to retake territory and mount new attacks.

Officials said at least 235 people were wounded in 28 different attacks launched in 19 cities, shattering a relative calm which had held in the lead-up to the start on Saturday of the holy Muslim fasting month of Ramadan.

The violence drew condemnation from the United Nations special envoy to Iraq, the country's parliament speaker, and neighbouring Iran, while Washington slammed the "cowardly" attacks.

In Monday's deadliest incident -- a string of roadside bombs and a car bomb followed by a suicide attack targeting emergency responders in the town of Taji -- at least 42 people were killed and 40 wounded, medical officials said.

"I heard explosions in the distance so I left my house and I saw a car outside," said 40-year-old Taji resident Abu Mohammed, who added that police inspectors concluded the vehicle was a car bomb.

"We asked the neighbours to leave their houses, but when they were leaving, the bomb went off."

Abu Mohammed said he witnessed the deaths of an elderly woman carrying a newborn baby and of the policeman who had first concluded the car was packed with explosives.

An AFP reporter at the scene said a row of houses were completely destroyed, and residents were rummaging through the rubble in search of victims and their belongings.

In Baghdad, meanwhile, a car bomb outside a government office responsible for producing identity papers in the Shiite bastion of Sadr City killed at least 12 people and wounded 33 others, security and medical officials said.

"This attack is a terrible crime against humanity, because they did it during Ramadan, while people are fasting," said one elderly witness who declined to be identified.

An AFP journalist said eight nearby cars were badly burned and many of the victims of the 9:30 am (0630 GMT) attack could not be identified because their papers were inside the targeted offices.

Two explosions in the Baghdad neighbourhoods of Husseiniyah and Yarmuk killed at least four people and wounded 27 others, while a car bomb in the town of Tarmiyah, just north of the capital, killed one and hurt nine, officials said.

There was no immediate claim of responsibility for Monday's attacks, but Al-Qaeda's front group in Iraq has warned in recent days it would seek to retake territory in the country.

The Islamic State of Iraq said in an audio message posted online that it would begin targeting judges and prosecutors, and appealed for the help of Sunni tribes in its quest to recapture territory it once held.

"We are starting a new stage," said the voice on the message, purportedly that of ISI leader Abu Bakr al-Baghdadi.

"The first priority in this is releasing Muslim prisoners everywhere, and chasing and eliminating judges and investigators and their guards."

It was not possible to verify whether the voice was that of Baghdadi.

Elsewhere in Iraq on Monday, checkpoint shootings and bomb blasts in restive Diyala province killed 14 people and wounded 47, security officials and doctor Ahmed Ibrahim from the main hospital in provincial capital Baquba said.

Insurgents also launched attacks on a military base near the town of Dhuluiyah, killing at least 15 soldiers and leaving two others wounded, according to security officials.

Two other attacks in the same ethnically-mixed province -- a checkpoint shooting and a car bomb near a Shiite mosque -- left three people dead and six wounded, officials said.

Nine bomb blasts, some of them minutes apart, meanwhile killed seven people and wounded 29 in Kirkuk city and the eponymous province's towns of Dibis and Tuz Khurmatu.

Three different attacks -- a car bomb, a roadside blast and a shooting -- in the main northern city of Mosul and the nearby town of Baaj left nine people dead and seven wounded, according to army First Lieutenant Waad Mohammed and police Lieutenant Mohammed al-Juburi.

A roadside bomb at a market in the centre of the town of Diwaniyah, south of Baghdad, killed three people and hurt 25, provincial health chief Adnan Turki said.

In Heet, a car bomb exploded near an army patrol, killing one soldier and wounding 10 others, according to an army captain and doctor Abdulwahab al-Shammari from the western town's hospital.

The attacks came a day after a spate of bombings across Iraq killed at least 17 people and wounded nearly 100. Monday's toll was the highest since December 8, 2009, when 127 people were killed.

The latest violence comes after the country suffered a spike in unrest in June when at least 282 people were killed, according to an AFP tally based on figures supplied by officials and medics.

Although those figures are markedly lower than during the peak of Iraq's communal bloodshed from 2006 to 2008, attacks remain common.

Beginning August 1st, 2012, Washington state traffic?ticket?and DUI law will take a big step towards more severe punishment for driving impaired.

On March 29th, 2012, Washington Governor Gregoire signed into law Substitute House Bill 2443.

According to the Washington state law from the Washington State Legislature, House Bill 2443 will offer harsher punishment for not only driving while in the influence of alcohol, but will offer increased punishment for those who ?huff? or inhale a hallucinogen. ?Before, the state had a hard time making a case for pulling someone over for the suspicion of driving under the influence of an inhalant or vaporized hallucinogen.

If you work with chemicals, such as paint or stains and don?t wear a mask. ?You could be at risk for being pulled over if you seem to be intoxicated from a chemical. ?For contractors and individuals who work in construction are pulled over for a such an offense, you could face heavy penalties and the stop will be treated like a DUI.

Washington state traffic laws have a unique ability to offer someone at 15-1 home detention as opposed to jail time. ?A good lawyer can negotiate this, so that if the sentence would be 5 days in jail, the sentence could be converted to 75 days home detention.

With the new law, jail time can be added in correlation with the home monitoring. ?60 days of home monitoring could receive an additional 4 days in jail, and 6 days for 90. ?This option is something that must be considered if you frequently drive to work, and cannot afford to miss work for jail time.
