Beginning August 1st, 2012, Washington state traffic?ticket?and DUI law will take a big step towards more severe punishment for driving impaired.
On March 29th, 2012, Washington Governor Gregoire signed into law Substitute House Bill 2443.

According to the Washington state law from the Washington State Legislature, House Bill 2443 will offer harsher punishment for not only driving while in the influence of alcohol, but will offer increased punishment for those who ?huff? or inhale a hallucinogen. ?Before, the state had a hard time making a case for pulling someone over for the suspicion of driving under the influence of an inhalant or vaporized hallucinogen.
If you work with chemicals, such as paint or stains and don?t wear a mask. ?You could be at risk for being pulled over if you seem to be intoxicated from a chemical. ?For contractors and individuals who work in construction are pulled over for a such an offense, you could face heavy penalties and the stop will be treated like a DUI.

We wanted to break this house bill down and update you on how this will affect traffic ticket law in Seattle.
Detention at Home (House Arrest)
According to the new law, repeat DUI offenders will have lnger periods of house arrest/ home detention based on the time frame of convictions. ?If you are a repeat offender within seven years of your first DUI, the mandatory home monitoring period- where an individual is monitored via electronic ankle bracelet- will now range from 60-90 days and 120-150 days for a third offense.
Jail Time for DUI Traffic Violations
Washington state traffic laws have a unique ability to offer someone at 15-1 home detention as opposed to jail time. ?A good lawyer can negotiate this, so that if the sentence would be 5 days in jail, the sentence could be converted to 75 days home detention.
With the new law, jail time can be added in correlation with the home monitoring. ?60 days of home monitoring could receive an additional 4 days in jail, and 6 days for 90. ?This option is something that must be considered if you frequently drive to work, and cannot afford to miss work for jail time.
